Maddington Kenwick Strategic Area Precincts 2 & 3

UPDATE: February 2025 

Council at its meeting held on 25 February 2025 resolved to support Scheme Amendment No’s. 166 and 169 to Town Planning Scheme No. 6 (TPS 6) to rezone Precincts 2 and 3B of the Maddington Kenwick Strategic Employment Area (MKSEA) from ‘General Rural’ to ‘Business Development’.

The City has recommended to the Western Australian Planning Commission (WAPC) that the scheme amendments be further modified as outlined in the Schedule of Modifications. A final decision on the scheme amendments will be made by the Minister for Planning. 

Background

The City of Gosnells (City) lodged an updated Environmental Review Document (ERD) to the Environmental Protection Authority (EPA.  On 16 January 2023, the City was advised that advertising of the ERD may occur, however, it was noted the Department of Water and Environmental Regulation suggested the City undertake additional water monitoring over winter.

The City has undertaken additional surface and groundwater monitoring over the winter periods of 2023 and 2024 within Precincts 2 and 3 of the MKSEA. The water monitoring data was provided to the EPA after the peak rainfall period and supplemented previous data collected by the City over a number of years.

The two scheme amendments and ERD were advertised for public comment. The City reviewed all public submissions and provided a report to the EPA (Summary and Response to Submission). The EPA released Report 1757 on 3 April 2024 with a recommendation to the Minister for Environment to not implement Amendments 166 and 169.

The City rejected the EPA recommendations and lodged an appeal with the Office of the Appeals Convenor (OAC).  A copy of the final report from the OAC can be viewed at the Office of the Appeals Convenor website. 

On 18 December 2024, the Minister for Energy; Environment; Climate Action decided to support Scheme Amendments No. 166 and No. 169 to TPS 6.  The decision was made following consultation with the Minister for Planning under s48F(1) of the Environmental Protection Authority Act 1986.

Precinct 2

• The MRS amendment to rezone Precinct 2 from Rural to Industrial was gazetted on 14 October 2016.
• Amendment No. 169 to TPS to rezone MKSEA Precinct 2 from General Rural to Business Development was initiated by Council on 13 December 2016 and forwarded to the EPA for consent to advertising for public comment.
• Council completes an Environmental Assessment and Management Strategy, Local Water Management Strategy, Geotechnical, Traffic, Bushfire Management, and Aboriginal Heritage reports for Precincts 2 and 3B.
• EPA determines that the Scheme Amendment is to be formally assessed - 3 September 2018.
• EPA issues Instructions for ER of the Scheme amendment - 21 December 2018.
• ER completed by the City of Gosnells and forwarded to EPA in May 2021.
• EPA requested further information in the ER document. Consultants engaged to undertake the additional work required by the EPA.
• The ER was reviewed by the (EPA).
• The EPA has released public advice that aims to enhance the long-term protection of the Greater Brixton Street Wetlands. For more information visit www.epa.wa.gov.au.
• The ER document and scheme amendment report was advertised for public comment.
• The City has reviewed all public submissions and provided a report to the EPA (Summary and Response to Submissions).
• The Minister for Energy; Environment; Climate Action has supported Scheme Amendment No. 169.
• Council at it's meeting held 25 February 2025 resolved to support Scheme Amendment No. 169 which is now being considered by the Western Australian Planning Commission.

Precinct 3A

• The MRS amendment to rezone Precinct 3 from Rural to Industrial was gazetted on 14 October 2016.
• Precinct 3A - Amendment No. 165 to TPS 6 to rezone Precinct 3A from General Rural to General Industry was approved on 12 December 2016.
• The WAPC approved a structure plan for Precinct 3A on 25 August 2017.
• The WAPC approved a Structure plan amendment for precinct 3A on 9 December 2021.

Precinct 3B

• The MRS amendment to rezone Precinct 3 from Rural to Industrial was gazetted on 14 October 2016.
• Precinct 3B - Amendment No. 166 to TPS 6 to rezone Precinct 3B from General Rural to Business Development was initiated by Council on 8 March 2016 and forwarded to the EPA for consent to advertising for public comment.
• Precinct 3B - EPA determines that the Scheme Amendment is to be formally assessed - 3 September 2018.
• Precinct 3B - EPA issues Instructions for ER of the scheme amendment - 21 December 2018.
• ER completed by the City of Gosnells and forwarded to EPA in May 2021.
• EPA requested further information in the ER. Consultants engaged to undertake the additional work required by the EPA.
• The ER was reviewed by the (EPA).

What will happen next?

• Amendments No. 166 and No. 169 to Town Planning Scheme No. 6 - Following the decision by the Minister for Environment, Council has considered the scheme amendments and provided a recommendation to the WAPC/Minister for Planning.
• The WAPC considers the Scheme Amendment and provides a recommendation to the Minister for Planning.
• The final decision on whether the Scheme Amendments may be implemented will be made by the Minister for Planning in accordance with the provisions of the Planning and Development Act 2005. The timing for a final decision is unknown.
• The City will commence the preparation of structure plans for MKSEA Precincts 2 and 3B.
