On 30 January 2024 it was announced that the WA Government plans to amend the Residential Design Codes (R-Codes) to allow for exemptions of Development Approval for Ancillary Dwellings (Granny Flats).

To qualify for the exemption, the proposal must meet the following:

  • Comply with setback requirements;
  • Must not exceed 70m²;
  • The property must not be zoned Rural.

In addition, the minimum lot size requirement has been removed and the car parking requirement may be varied depending on density and location.

The amended State Planning Policy 7.3 became operational in mid-April 2024.
